Family To File Wrongful Death Lawsuit Against Veterans Affairs

PITTSBURGH (KDKA) - The family William Nicklas, 87, of Hampton Township, filed notice that they intend to file a wrongful death lawsuit against Veterans Affairs after his death at the VA's Oakland facility on Nov. 23.

Attorney Harry Cohen said he was diagnosed as having legionella pneumonia after being treated there for a shortness of breath in early October.

He was treated and eventually released. However, he was readmitted with different symptoms.

Nicklas was notified of the legionella infection the day before Thanksgiving.

At a news conference, his son David said, "He trusted that the VA would give him the best care and they betrayed that trust."

Nicklas enlisted in the Navy in May of 1944 and was honorably discharged in May of 1946.

He ran an auto body shop in Glenshaw.
