Man Suing After Assault At Local Bottom Dollar

PITTSBURGH (KDKA) – Mike O'Shea went to the Bottom Dollar in McKees Rocks one night after work to buy cookies and milk.

But he left with a bunch of busted teeth, a bleeding mouth and a torn up knee.

"He hit me in the mouth, he hit me on the side of my head too," said O'Shea.

All of it was caught on tape – store surveillance video shows the assault on O'Shea.

"I felt my teeth breaking as soon as he hit me," he said.

According to police who arrested the man assaulting O'Shea, the suspect jumped in front of him in line at the Bottom Dollar. When O'Shea tried to pay, he punched him several times.

"I was bleeding, busted all of my caps, tore my meniscus," he said.

O'Shea is now filing a lawsuit against the store and the security guard. If you look in the upper left hand side of the video, you can see the security guard.

O'Shea says he never intervened, never tried to help, but believes he should have.

I don't expect him to stun gun people, but he could have at least tried to intervene," O'Shea said.

The suspect is wanted by police – there is an assault warrant out for his arrest.

O'Shea is fine with local police, he believes security guards should be prepared to do more.

"It says 'security' on his arm," he said. "That means Bottom Dollar is hiring anyone that has 'security' on his arm – it's not even meaningful."

A manager at the store said he's not allowed to comment on the case.

Officials at corporate headquarters also said they were not allowed to comment due to pending litigation.
