Police: Woman Used Sister's Bank Card On Day She Died

JOHNSTOWN, Pa. (AP) - Police have charged a western Pennsylvania woman with identity theft because they say she used her sister's automatic teller machine card to withdraw $120 on the day she died.

Online court records don't list an attorney for 25-year-old Jera Lynn Benito.

Johnstown police say they used bank surveillance video to identify Benito as the person who used the card to withdraw money from the account of her sister, Samantha Mae Benito, on March 10. Samantha Benito had died the same day.

Police say Jera Lynn Benito tried to use the card again three days later, but the bank had been notified of her sister's death and frozen the account.

Police say Benito told them she didn't know that using the card under those circumstances was illegal.

She faces a preliminary hearing April 30.
