2nd Hearing Held For Lifeguard Accused Of Sexual Assault

PITTSBURGH (KDKA) – Thursday held the second hearing in a week involving sexual assault charges against 29-year-old Michael Kelly.

Thursday's hearing, like the previous one, was complicated by testimony from the alleged victim that indicated there was a consensual relationship.

Even so, Kelly was held for trial on rape and aggravated assault charges.

Kelly is free on bond, but refusing to talk about the growing number of charges against him. They center on two women who worked at the Upper St. Clair recreation Center. Both claim Kelly sexually assaulted them at the center and at his home.

Kelly's attorney says the latest accusations were part of a consensual relationship.

"She now, years later, claims that somehow in the midst of a consensual relationship there were episodes of non-consensual which we don't believe to be credible," said attorney Charles Porter.

Jane Doe No. 2 in the case testified that Kelly followed her into a storage room at the rec center and forced himself on her. The first Jane Doe, who was 16 at the time, says she also had sex with Kelly in the storage room, but admitted it was consensual.

"I don't think it shows a pattern," said Porter. "I think it shows a situation where they took advantage of where they were located to engage in activities that she should have probably done in their home."

Kelly's charged with rape. He's also accused of aggravated assault for allegedly holding a knife to the woman's throat.

In the case of the 16-year-old, the sexual assault charges were dropped, but he's charged with corrupting a minor and endangering the welfare of a minor.
