Charges Possible Over Video Of Black Student Eating Chicken

EASTON, Pa. (AP) – A teenager accused of producing a racist video of a black classmate eating chicken and posting it online could face criminal charges, a prosecutor said Wednesday.

Northampton County District Attorney John Morganelli said he’s considering ethnic intimidation and harassment charges against a 14-year-old white student at Saucon Valley High School.

The teenager recorded a 16-year-old black boy eating chicken wings and in narrating the video called the older boy the N-word and made references to “being broke and on welfare,” said Morganelli, who called the video “reprehensible” and “repulsive.”

After seeing the video on social media, the black student attacked the white student at a football game, Morganelli said. Lower Saucon police charged the black student with assault and other offenses; the charges are pending in juvenile court.

Morganelli opened the probe on Wednesday after an attorney for the black student showed him the video.

The Saucon Valley School District investigated the incident and “handled it very appropriately,” schools Superintendent Monica McHale-Small told The Morning Call newspaper of Allentown. She called the white student’s behavior “incredibly vile.”

The students’ names haven’t been released.

Last month, parents and students told the Saucon Valley School Board about several other racist incidents. One student said she was asked if she was drinking from the right water fountain and then was told the fountain was only for whites, the newspaper reported.

  1. John McBride says:

I guess the US Constitution doesn’t apply in Pennsylvania?

    1. Art Carney says:

only when democrats want it too.

    2. Lola Green says:

You seriously want to defend that as free speech?? You are right about one thing, you can say what you want but be prepared for the consequences. There is no excuse for what that kid did and for you to defend it is ridiculous

      1. Kevin Nelson says:

I didnt see anyone defending what he said, simply his right to say it.

      2. There cannot be persecution with the law for speech, unless it is threatening someone directly. Otherwise we should need to arrest every black person who disparages whites, which would be almost all of them. This is purely a racially motivated case, where the black prosecutor is simply trying to cause harm to the white boy out of his own racial feelings. This prosecutor should get disbarred and thrown in prison for this.

      3. Lola,

You appear confused. The whole point of freedom of speech is to protect all points of view, even the ones you find reprehensible. I agree that there are consequences… IE: the black kid kicked his a$$ at the ball game. However, the prosecutor cannot legally go after him as his opinion is protected by law.

      4. John McBride says:

        Lola,

You ignorance of the importance of the First Amendment is troubling.

      5. Carl Mayo says:

Loosie Goosie & John Mcbride: “Lola Green” is not a real person. It’s a paid government troll with a fake FB account.

      6. Ok. Accordingly an offended person is free to kick the living snot out of the next person BURNING THE AMERICAN FLAG and answer to no punitive charges. Just have the lawyer refer to this story for jurisprudence.

      7. If speech isn’t allowed the possibility of offending, it isn’t free speech.

      8. The more repugnant speech is, the more vigorously it should be defended, if we want any hope of the first amendment existing in 20, 50, or 100 years from now.

    3. Fred Garvin says:

Welcome to the State of Dependence.

    4. Free speech is not protected in the Constitution, it is protected in the Bill of Rights.

      1. The First Amendment (Amendment I) to the United States Constitution prohibits the making of any law respecting an establishment of religion, ensuring that there is no prohibition on the free exercise of religion, abridging the freedom of speech, infringing on the freedom of the press, interfering with the right to peaceably assemble, or prohibiting the petitioning for a governmental redress of grievances. It was adopted on December 15, 1791, as one of the ten amendments that constitute the Bill of Rights.

The reason that Amendment 1 came first was the importance of PERSONAL LIBERTY, no matter how offended YOU are,,,the right to FREE speech is absolute….BTW go back to school “YOMMMA”

    5. Tim Brennan says:

Actually no the constitution does not apply here . There is a long standing legal principle that when children are left in the care of an adult the adult is responsible and has a measure of control over them. What this kid did was wrong but it should be treated as a teachable moment not a criminal case. The school and by extension the school bus driver has an obligation to provide a safe controlled environment assuming you beleive in equal protection which is an actual constitutional principle at stake here

  2. Art Carney says:

Well the word police are out. maybe they should read the 1st amendment. They are the one who say it there to protect speech we do not like. Maybe this D.A. should listen to some rap music. There would be a lot of so called artists going to jail

  3. When is this idiocy going to stop? Way past time.

  4. One is freedom of speech, the other is assault. There is nothing in the Constitution about guaranteeing a right not to be offended.

    1. Osama Bedead says:

Oh, I’m sure there must be such a right guaranteed somewhere in the Constitution or the snowflakes wouldn’t keep saying they have a right not to be offended.

But a larger issue is why wasn’t the Black kid arrested for a hate crime when he ate fried chicken promoting that racist stereotype? Black people shouldn’t be allowed to eat fried chicken. It offends me.

      1. dt60093 says:

Anything that reminds me of slavery is highly offensive to me, and Blacks remind me of slavery.

  5. Mike Favetti says:

Yawn, have they nothing better to waste time on? Let the kids fight it out, that’s how we used to settle our differences!

  6. Admin-c says:

What ever happened to “sticks and stones”? Oh wait, freedom only applies to certain select groups.

    1. Dan Bull says:

I hope that you teach your children not to use the N word and not to disparage people for being on welfare.

      1. David White says:

And teach them to not say gringo, cracker, whitey, redneck, round eyes.

      2. Jerry Walton says:

While what the white kid said was bad, it did not reach the levels of assault and battery.

      3. Larry Jones says:

Only if they don’t act like “N’s” and are truly disabled and deserve help.

      4. That’s kind of the point, isn’t it? That’s the job of a parent to teach, not a court system.

  7. SO WHAT. Who cares what he did, the BLM have done way worse, don’t ya think?

  8. Frank Muller says:

Chocolate cities are a disaster. Search YT for “Colin Flaherty” for the true story.

    1. bookinweasel says:

      Hershey, Pa being the exception…

  9. Frank Walker says:

Young people are so impressionable. I blame Obama for dividing us like this. I dearly hope President Trump will work hard to bring us back together, and I think he will.

Black people here are legal American citizens overwhelmingly. Trump does bring prejudice against non-citizens here illegally, but he sees all American citizens as equal, and that certainly includes virtually all black Americans. Trump believes America should be a nation of laws, and that our laws MUST be enforced. That separates him from Clinton, Bush, and Obama. But that view does not threaten black Americans and, indeed, it might actually be beneficial to them. I hope so.

We should be giving priority to assisting our OWN citizens rather than huge numbers of illegal Mexicans and Muslims. America FIRST!!

  10. Ben Franklin says:

The video sounds reprehensible, but not nearly as reprehensible as charging people with crimes for what they say.

  11. The media uses a lot of teenager B.S. as proof of white hate crimes. No it is just dumb kids (any race) doing dumb stuff.

  12. Jabber Joe says:

    Adjectives used about the video:
    Racist
    Reprehensible
    Repulsive
    Incredibly Vile

    Adjective used about the Assault:
    NONE

    1. Brad Ruley says:

The white kid deserved to get punched. You reap what you sow.

  13. John Oakman says:

Soon, very soon the white Enablers are going to be eating chicken.

    1. Ben Franklin says:

I eat more chicken any man ever seen.

  14. The video may indeed be “reprehensible” and “repulsive,” but it is also protected by the First Amendment.

This would be a non-story if not for the fact that it points out the ignorance of the very basics of our law, the Constitution, displayed by Northampton County District Attorney John Morganelli.

  15. PC is a far left liberal creation used to CONTROL others. Beat PC to death with a dull ax.

  16. Jerry Snaper says:

Its the parents, Black, White and Brown to responsibly train their children. A tough job these days with obaaama , leftists and the vile stories we hear in the news each day.
And remember children are children and will say and do the darndest things. Remember your youth. I believe all of these multicolored distractions are part of the islamic agenda to split America and bring it to Dhimmitude. Remember islam thinks in centuries to destroy civilizations.

  17. Jns Eq says:

Something tells me Northampton County is going to be forking over a lot of money to a white family. You sure you want to continue this leftist renunciation of the Constitution, Mr. District Attorney?

  18. Jns Eq says:

“After seeing the video on social media, the black student attacked the white student at a football game…”

    Surprise!

  19. Hiram Floss says:

but video of blacks beating up a white Trump voter while laughing and calling him a “cracka” gets no coverage and no chages. OK got it. SHUT UP WHITEY!

  20. David White says:

So black people can make videos calling for the murder of whites (https://www.youtube.com/watch?v=hVcfymOvoUo), and not be arrested, but white folks can’t even mock someone. Separate, but unequal.

  21. It is not a crime to call someone the N word….or film them eating chicken….is it role model behavior? No….but a crime? LOL….

Just bc one race does not like someone from another race does not make them a criminal….a bigot? Yes….and I try to live my life according to God’s word and love everyone equally…it is hard when you see so much ignorance and false accusations in the world today….we need to pray and hope that God will bless this nation…and our people….all of us…every race….

  22. Yirmin Snipe says:

Was there anything in the video that was untrue? If so the slander and libel laws could come into play… but barring any of the statements being false this is just a free speech matter. You might not like what is said but that is the whole reason you have to protect speech from censorship.

  23. Bobby Bonds says:

Guess we cant say whatever we want these days unless we are a liberal and stick the script. Not saying what he said was right – but idiot liberals get to say all sorts of trash.

  24. As described, the video is ignorant, offensive & crude. Criminal? Not a chance. If the school chose to suspend the student, I would understand that completely. However, criminal charges are ridiculous.

  25. MH Thomas says:

The death throws of Political Correctness will not be pretty. Stand by.

  26. Don Beck says:

I went to school with black kids in the eighties, and they need no provocation to get violent. No one gives them the idea its not correct, they are enabled and molly coddled and have their childish impulses validated by the effeminate libs who run the schools. I am sure it is far far worse, now. its practically child abuse to send your kids to school with black kids.
I say, segregate them again. The experiment has set America back severely.

  27. If SNL did a skit on the same subject that would of been FUNNY!

  28. Andy Foster says:

The author should also face charges. In the third paragraph, he refers to the subject of the video as “a black boy”. A BOY? That’s a highly racist comment.

  29. “Sticks and stones can break my bones, but words….” Never have understood why it’s not a problem for blacks to call each other a N*@@er, but it is for a white guy to do the same. I guess I must be a racist.

  30. haven’t we come a long way. isn’t diversity wonderful!

  31. when did being an A-Hole become a criminal offence… this is horsesh1t as we all know it isn’t news if a black person intimidates a honky

  32. The white boy got he deserved. That should have ended it. If you think you have a right to bully or ridicule someone (who has an expectation of privacy) on social media. You also have the right get your ass whipped.

  33. I guess Jay Z and other rappers better not go to Pennsylvania.

  34. Tim Brennan says:

NOT defending the kid what he did was wrong but what has happened to in school suspension? Does he play sports or band that he can be suspended from? I agree with punishment but criminal charges ? a little common sense here please .

  35. Kirk McLoren says:

when they prosecute for “polar bear hunting” they can prosecute chicken videos with the N word. Until then the racist establishment should stay out of it

  36. The white student’s actions were disgusting and vulgar.

And he deserved to get his butt kicked by the black student.

But that doesn’t change the fact that Government does not have the right to try to thwart his disgusting speech. Its utterly ridiculous that the kid may be facing charges.

If he took the video at school, then he can be punished within the school system. That is appropriate. But this is not criminal.

    CML

  37. Calling people names is not against the law, hitting someone because they were called a name is though.

  38. Zack Watkins says:

The one kid is an ass, but criminal charges will not correct any racism here. The white kid will hate black people even more after he is charged and convicted of a hate crime. The black kid will hate white people after being mocked by the white kid and it being all over the internet. This is a vicious circle that keeps working both ways.

  39. Kay Hull says:

Wait a minute. This “racist” event happened in the North? Pennsylvania? There couldn’t ever be “racists” living in the North? I thought all “racists” were from the South?

  40. I sure hope they prosecute this kid. I want all young people to learn what Communism is at a very early age.

  41. “We must realize that our party’s most powerful weapon is racial tensions. By propounding into the consciousness of the dark races that for centuries they have been oppressed by whites, we can mold them to the program of the Communist Party. In America we will aim for subtle victory. While inflaming the Negro minority against the whites, we will endeavor to instill in the whites a guilt complex for their exploitation of the Negros. We will aid the Negroes to rise in prominence in every walk of life, in the professions and in the world of sports and entertainment. With this prestige, the Negro will be able to intermarry with the whites and begin a process which will deliver America to our cause.”

  42. Ren Bis says:

It reads as if these two already settled the matter….Leave it alone…
BTW, I read “bullying” in your PUBLIC STATEMENT McHale “Incredibly vile.” YOU should be released of your duties for going after a 14 year-old minor in a public forum……If I were the parents of that 14 year old, you would be facing a Defamation lawsuit….as well as Malicious Prosecution…

  43. It is rude and crude…….but NOT illegal. Grow up !!!!!

  44. So taking a video is now a crime????

This prosecutor should get disbarred and thrown into prison himself.

  45. Since when do racists not get First Amendment protection? In the NFL, the “N” word is so commonly used by black players that the NFL changed the rules to exclude that word as “hate” speech and allowed it to continue. Only due to the wide spread sue by black players.

  46. Wow… Ethnic Intimidation… Hmmm… You mean like when someone says “Black Power”, “Brown Power”, or even “Black Lives Matter” ?? Seems to me those are Intimidation against White people… Where are the arrests?

  47. John Morganelli is a typical leftist… attacking anyone who dares to say anything he disagrees with. I don’t see why the DA has to get involved. The black kid kicked the white kid’s a$$ already. It appears it worked itself out. I am so tired of these government officials creating this “protected class” of people… of course no white person is afforded the same courtesies. If some racist blacks beat a white kid to death just for being white, no one would care. No wonder so many whites are so upset.

  48. It’s way past time to tell the thought police to go fück themselves.

  49. KFC is henceforth forbidden from using Black People in their advertisements.

  50. So when is the DA going to start prosecuting the hundreds of violent black criminals who have assaulted whites unprovoked in the “knock-out game?”

  51. Notice how prosecution for “hate crimes” only ever go in one direction, even though whites are the victims in 95% of them.

  52. Lib Serum says:

I’m Euro-American and don’t believe in over reacting to things like this, but this is not an over reaction. The kid taking the video and posting it needs to get disciplined and give an apology to the 16 year old. Can’t blame the other kid for punching mister idiot movie maker.

  53. Ra Williams says:

Sounds like justice has already happened. Street justice. Drop all charges against both kids.

  54. Sounds like free speech to me. Of course assault is still illegal but I’m confident the professional victim groups will prevail in court.

  55. Roe Bauer says:

    This Man has gone Mad…!!!

Someone needs to Slap this Moron silly until He wakes up or give Him a Dose of Lithium….!!!

Northampton County District Attorney John Morganelli is Fuken Idiot….!!!

  56. Grizz Mann says:

Was the young film maker Quentin Tarantino’s son?

  57. I believe this is unConstitutional.

  58. the DINDOO NUFFIN nation is enraged….they plan to sucker punch some old guy and shoot a cop as retaliation. LOWRETTA LINCH said “Yoo go booooyeeeeee.” The president was found fumbling with his zipper in white house public mens room. Harry reid was him. smiling.

  59. Did they really refer to that kid as a “black boy” in the article?!

    Let’s press charges…..

  60. One minute the cops protect a Black from Free Speech and the next minute he shoots the cop in the back.

  61. Kelly Laraia says:

Neither the white kid or black kid should face any charges. Let them handle it between themselves.

  62. Spider says:

We don’t have a First Amendment to protect speech that you agree with, we have a First Amendment to protect speech you don’t agree with. What part of that simple concept don’t progressives understand? Ah, but we must remember that the political progression is “Progressive” aka Liberal Democrat, then “Socialist” not to confused with social media and finally we have “Communist”. That is the end game for today’s Democrats. And that is where you need to remember what Comrade Vladimir Lenin once said: “It is true that liberty is precious; so precious that it must be carefully rationed.”

  63. Blacks have a great life in the United States. Where else in the world can a single Black woman have six children from six different “Baby Daddies” and collect $60,000 in cash cards and housing benefits, free medical care for her family, pay no taxes, doesn’t even have to look for a job let alone work, and when her children are in school they get two or three free meals a day, and even free meals in some states during summer vacation. And the “Baby Daddies” don’t ever have to pay child support. Life is good in the hood.

  64. It is despicable and racist; but for a 14 year old, is this really a crime? It certainly isn’t acceptable, but sometimes for the sake of freedom, we must accept speech we find horrible. It is in defending the worst cases that we defend the whole principle.

  65. Another example of “fake news”.

  66. So black people screech and scream for segregation and when its delivered to them they cry foul.

Damn Lincoln for getting himself killed before he could send them all home.

  67. Max Conrad says:

Democrats practically have a part time job calling all white people evil racists and Republicans are called Nazis. Is this considered “friendly” speech?

  68. I agree that it was despicable, reprehensible” and “repulsive, but so in disrespecting our flag. if one is protected by the first amendment, both should be… He should be punished by his parents, NOT by criminal charges…NOT IN AMERICA.

  69. This is the stupidity that democrats have brought to our society.

  70. Greg Munson says:

This story is accomplishing just what racists want – attention and publicity, just like the 250 White Power loons who attracted 50 mainstream media reporters at a meeting in DC. It would help if everyone just ignored stories like this as just one more example of stupid behavior – and stop treating it as news just because it’s racial – that only encourages the loons.
Once again, the media just doesn’t get it.

  71. Mike Arvand says:

Funny how things are only racist if a black person is offended by them. If this had been a video by a black person calling another one a n–ger, or a black person filming a white person calling them a cracker and a hoe – they’d be laughing about and facebook would be displaying it as “art”

Funny too, how cracker won’t trip up offensive language. but the more common term for porch monkey will.

  72. Where you find Africans you find Africa.

  73. if the shoe fits….. prejudices are most often learned by experience….might want to think about that

  74. “ethnic intimidation and harassment”….???

That describes entire non-profit groups such as CARE.

  75. Someone should send D.A. John Morganelli a link to worldstarhiphop.com and watch the videos that niqqaz play on white civilians.

  76. I thought these kids had been taught the beauty of diversity throughout their school years…….what happened? seems ALOT of kids across the country are more racist than the adults ever are.

  77. ethnic intimidation and harassment”….???

That describes entire non-profit groups such as CAIR.

  78. White are beautiful Ethnic European Children placed in these zoos to begin with?

  79. slothb77 says:

The kid narrating the video called the other kid the n- word. Sounds racist to me.

    1. Sean Martin says:

No one is saying video isn’t racist. It is. The point is that just because someone hurts your feelings doesn’t give you the right to attack them then have the gvt try to bring charges against the person you assaulted.

  80. Sean Martin says:

Thuggish neanderthal with poor impulse control beats kid to prove that he is not a thuggish neanderthal with poor impulse control…

  81. Lee Jenkins says:

I love this! We should ALL have freedom of speech and we should ALL also have the freedom to kick the ass of someone being a racist idiot, black or white. If there was a little more ass-kicking going on, we’d probably have less need for freedom reducing rules and regulations.

  82. Barry Hirsh says:

    Charges? You’re kidding, right? RIGHT???

  83. Its not the person behind the posting, its the smart phone. ban all smart phones.

  84. Free speech in America is still FREE! Just do not say “FIRE” in a crowded theater!
And never mind the “symbolism (of speech) over substance (physically attacking another person)!
Punish the act NOT the words!

  85. Jeff Howard says:

You have to be taught to act this way. The media has done a good job of grooming this type of behavior from youth.

  86. was the victoms blacks???

  87. What the White kid did was a lot of things. But one thing they NOT are, is illegal.
    — The White kid doesn’t think much of Blacks, big deal. Your ‘thoughts’ are not illegal.
    — Calling the Black kid a ni##er. Offensive and 100% un-pc, but not illegal.
    — Filming a Black eating Chicken. That enforces a stereotype of blacks. It’s un-pc but not illegal.
Bottom line, everything the kid did is Protected by the Constitution. The whole purpose of the 1st Amendment is to protect ‘speech’ (as its been defined) that IS objectionable, offensive, and un-pc. After all, there’s no need to protect something that everyone agrees with.
If this kid is criminally charged with anything, they better get ready to pay out millions when they are sued for violating his civil rights. (but the School CAN discipline him)
Oh, and they BETTER Charge that Black kid. His actions are NOT protected and are 100% illegal. Being offended doesn’t give you a right to beat the ‘heck’ out of someone.

  88. I would have to see the video to be sure, but let’s get real here.
Was this “actual” racism, or just some kid using “angry words” about a problematic system and maybe a person that’s a slimeball he was being critical of using offensive words?
There IS a huge difference people….. The problem is, liberals don’t know that difference exists.

  89. depending on the actual incident, the first charges against the black student should be dropped. Traditional law includes the idea of fighting words. I assume the white student continued using them when confronted with the video (and would have been chargeable under harassment anyway). But I’m only guessing. What actual happened needs to be brought up in court – and the media is rarely truthful and spins, exaggerates, and leaves out facts about everything.

  90. Of course, the white student is 2 years younger than the black student, which indicates it may not be as reported above.

  91. How is this even a thing? What law did he break?

  92. If we draw a line as to what speech is legal and what speech is not based on someones beliefs over another, then we begin down that slippery slope toward tyranny. Who gets to decide what is acceptable and what is not?

What the boy said was disgusting and racist, but I 100% defend his right to say it. If you do not understand this then you are an enemy of the United States of America.

ALL speech is protected. Unless some other law is broken such as making a threat or something then there is nothing to see here from a legal perspective.

  93. Mark Calvin says:

Nobody owes “nwords” chicken or bandaids for their feelings. It’s enough you get to live in our countries for now. Things will be better for you after you get on the #freedomboat to #Liberia.
