Felony Charges Dropped Against Mother Of Drowned Toddler

PITTSBURGH (KDKA) – The felony charges against an Indiana County mother accused of her toddler drown in a bathtub were dropped Monday.

Tonya Thomas, 28, and her husband Wesley Thomas were both charged after the incident.

Thomas told police their 13-month-old son drowned in the bathtub after he was left unattended with his 2- and 3-year-old siblings for just a few minutes.

Tonya Thomas faced two felony charges – homicide and aggravated assault – but the judge dropped the charges, saying that she found no malice or intent on the mother's part.

Thomas, who is pregnant again, was also released from jail on a non-monetary bond.

Wesley Thomas is still in jail.

However, both Thomas' still face misdemeanor charges.

The District Attorney was trying to seek a third degree murder charge, which if convicted, could have meant that Thomas would serve 20 to 40 years in prison.
