Get Marty: Toys 'R' Us Layaway Limbo

MONACA (KDKA) -- A local family was stuck in layaway limbo.

They paid for a swing-set, but were then told they couldn't have it. That's when they decided to "Get Marty."

They had to do a little heavy lifting at the Toys 'R' Us in Monaca, but the real work took place long before Josh and Danielle Ginther loaded up the swing set.

"It's just been a royal pain. I'm ready to get it over with," says Danielle about this Toys 'R' Us tiff over the backyard swingset.

The Ginthers bought it for their son Grayson's fourth birthday a year ago.

Here's what happened: when the Ginthers bought the swingset, they left it here for too long, for nearly a year.

In fact, the Toys 'R' Us "Delayed Pickup Policy" states that "If the item is not picked up within 30 days, the item will be considered abandoned and returned to store stock."

The Ginthers were fine with that and just wanted a refund.

"I was pretty shocked when I found out they thought they were going to keep my money as well," says Danielle. "They told me there was nothing they could do for me; it had been too long. They had no proof that I hadn't already picked it up."

Was he accused of stealing it?

"Basically, yeah," he said.

That's when she sent KDKA an email.

The swingset was $650 and they expected the family to walk away.

We took it right to the top, to corporate Toys 'R' Us officials, who responded immediately, saying they were looking into it as we spoke. It was followed almost immediately by this:

"The customer should receive a call tomorrow to seek a resolution."

Within 24 hours it was resolved. Danielle was promised a full refund or the swingset to fill the grassy gap in her backyard for a 4-year-old waiting on a birthday gift, which brings us back to the Toys 'R' Us in Monaca.

The swing set was loaded up, and the problem was solved.

"It's been crazy," says Danielle. "I figured you were the man for the job."
