Ruling Clears Way For Pennsylvania AG Kane's Criminal Trial

HARRISBURG, Pa. (AP) - Pennsylvania's highest court is declining to intervene in the criminal case against the state's top prosecutor, clearing the way for jury selection to begin Monday.

The Supreme Court on Friday turned down Attorney General Kathleen Kane's request that it take up her claim the grand jury that investigated her was unlawful and unconstitutional.

The first-term Democratic attorney general is accused of leaking secret grand jury material in another matter and lying about it under oath.

Kane's argued that the lawyer who served as a special prosecutor and ran the grand jury lacked authority to act as a prosecutor.

Kane isn't running for a second term.

A spokeswoman for the Montgomery County prosecutors handling the case is declining comment. Kane's lawyers didn't respond to requests for comment.
