Charges Re-Filed Against Mother In Boy's Drowning Death

INDIANA, Pa. (KDKA) -- An Indiana County woman is once again facing charges in the death of her young son.

Tonya Thomas, 28, was recharged today with criminal homicide and aggravated assault.

Her 13-month-old son, Ryden, drowned in a bathtub back in February while left in the care of his 2-year-old and 3-year-old siblings.

The same magistrate dismissed these most serious charges against Thomas last week, but today the charges were re-filed.

The District Attorney says nothing has changed, but he'd like the judge to take another look at the case.

He says he wants to make sure the judge understands that he is seeking third-degree murder, which does not require that the death be intentional if there is malice and disregard for the victim present.

Thomas, who is currently pregnant with another child and due in early summer, remains on house arrest on a $250,000 unsecured bond.

Her new preliminary hearing scheduled for next week will likely be continued until later in the summer.

Thomas' husband, Wesley, is also charged with reckless endangerment and endangering the welfare of a child. He waived his preliminary hearing last week and is currently awaiting trial.
